COLLECTION AND USE OF PERSONAL INFORMATION

We collect most of the personal information about you directly from you—in person, by telephone, by email, and/or via our Site.

Personal Information That You Provide To Us. You may provide us with certain personal information, such as information collected directly from you when you provide it to us, such as information that you provide by filling in forms in-person or on the Site. We may collect the following categories of personal information:

  • Identifiers: Information that identifies, relaltes to, describes, or is capable of being associated with, a particular individual
  • Payment information: Includes account numbers, credit or debit card numbers, etc.
  • Commercial information: Purchase and transaction history.
  • Internet or other electronic network acvitity: Mobile device and browser information, online identifiers, Mac address, IP address, cookie IDs, browser activity, serach history, and information regarding your interaction with our website.
  • Precise geolocation data
  • Demographic information: May include age, gender, and income.
  • Sensitive information: Data such as financial information and precise geolcation data. We will not process your sensitive data without obtaining your consent. 

Specifically, we collect following information:

  • Land to Sell: If you choose to submit information to Fischer Homes regarding land you are interested in selling, we may collect your name, address, email address, and phone number along with the geographic location, approximate acreage, and current zoning of the property, the desired time to sell, whether there are any sanitary sewers available or near the property, and any questions or comments you might have for Fischer Homes.
  • Marketing Communications: If you sign up to receive our marketing emails or we otherwise have your consent, we will collect and use your email address to send you emails about new opportunities, homes, communities, special offers, and other information. Likewise, signing up for an interest list or submitting a contact form may result in follow up correspondence from a Fischer Homes representative. If you no longer wish to receive these communications, you can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of any marketing email. Alternatively, you can opt out of receiving our marketing emails by contacting us at the contact information under “Contact Us” below. Please note that you may continue to receive certain transactional or account-related communications from us. We may also use services provided by third-party platforms to serve tailored advertisements on those platforms, and we may provide a hashed version of your email address or other information to the platform provider for such purposes. From time to time, we may ask you to confirm or update your marketing preferences if you instruct us to provide further products and/or services in the future, or if there are changes in the law, regulation, or the structure of our business.   • Employment: When you apply for a job with Fischer Homes, we may collect your name, address, email address, phone number, resume, work history, education history, and any additional information required for the application process.
  • Learn More; Tour a Model Home; and Begin Personalizing Your Fischer Home In-Person or on the Site: If you sign up for one of our educational programs or fill out a guest information or registration card at a Fischer Homes sales office, design studio, or model home, or submit information using one of the corresponding forms on the Site, we may collect your name, address, email address, phone number, and any additional information that you may provide to us.
  • No Obligation Pre-Qualification: If you choose to submit your personal information to see if you're pre-qualified for a Fischer Home, we may collect your name, email address, address, phone number, region of interest, and any referral information or names of employees you have previously contacted. Such information will be disclosed to and processed by our mortgage subsidiary, Victory Mortgage.
  • Homeowner Stories: If you submit a review to us to be included on the Site, we may collect your name, address, email address, photograph, video, phone number, and any additional information required for the Site.
  • Identity Verification Information: In certain contexts we may be required to verify your identity by collecting information such as your social security number, driver's license number, state or federal identification number, and similar identifiers.
  • Commercial Transaction Information: We maintain records of commercial information related to our services, including records of property obtained, products, or services obtained or considered from Fischer Homes or others, as well as your purchasing or consuming history and tendencies.
  • Financial Information: When we facilitate financial transactions or use one of our subsidiaries to facilitate the financial transaction, we may collect personal information related to such services, which may include information about your credit, personal finances, real estate and rental history, and similar information. Additional information about Fischer Homes’ privacy practices with respect to financial information will be provided in the appropriate manner based on the nature of the services.
  • Personal Characteristics: Using the information we gather about you, we may infer characteristics about you pertaining to your personal preferences (such as your taste in community, home, or furnishings), your characteristics (such as your buying power) and your behavior. We maintain this information to provide more tailored services to you and to present you with content, communications, and choices that are relevant to you.
  • Records of In-Person / Telephonic Interactions: We may collect personal information about your in-person interactions with our services and facilities. For instance, if you visit one of our physical locations (such as a Fischer Homes community, property, or office), we may collect audio or video footage taken at or near the location (and collected consistent with local law). If you interact with us on the Site, over the phone, via mail, or email, we will collect and maintain records of your interactions, including through telephone records, voicemails, emails, chat histories, and messaging histories.
  • Create an Account: You are not required to create an account to access or use our Site. If an account is created for you by Fischer Homes, we collect your email address and a password you create in order to create and administer your account. We also may collect your consent to send you marketing communications, which is optional. We use this information in order to provide the best possible Site experience for you and for our legitimate interests, i.e., to be as efficient as we can to deliver the best service for you. Do not disclose your password to anyone. If you become aware of any unauthorized access to or use of your account, you must notify us immediately.

We may also collect your information if you contact us for customer service purposes:

  • Customer Service: When you contact us with a comment, question, or complaint or complete our customer service form online, you may be asked for information that identifies you, such as your name, email address, mailing address, and a telephone number, along with additional information we need to help us promptly answer your question or respond to your questions or comments. We may retain this information, including records and copies of your correspondence, to assist you in the future and to improve our customer service and service offerings.
  • Chat Feature: If you choose to use our chat feature to engage with our customer experience team, we may collect your email address and any message that you choose to include in your communication. We may retain this information to assist you and to improve our customer service and service offerings.

Cookies & Other Technologies. A cookie is a small file containing a string of characters that may be sent to your web browser when you visit a website. Pixels. Pixels (also known as web beacons) are code embedded within a service. INTEREST-BASED ADVERTISING / RE-TARGETING

We may partner with third parties such as ad networks and other advertising companies to display advertising on our Site and manage our advertising on other sites. Our third-party partners, listed above, may use technologies such as cookies and pixel tags to gather information about your activities on our Site and other sites (such as web pages you visit and your interaction with our advertising and other communications) in order to make predictions about your preferences and provide you with tailored advertising across the Internet based upon your browsing activities and interests.   • Law enforcement and other government agencies and regulatory bodies to comply with our legal and regulatory obligations

We only allow our service providers to handle your personal information if we are satisfied that they take appropriate measures to protect your personal information. We impose contractual obligations on service providers, contractors, and third parties to ensure that they can only use your personal information to provide services to us and you.

We may aggregate your personal information and disclose such aggregated information to advertisers for other marketing and promotional purposes. However, we will not disclose to these entities any information that could be used to personally identify you.

We may process and transfer your personal information in and to a foreign country, with different privacy laws. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country.

We may also need to share personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically de-identify information, but this may not always be possible. The recipient of the personal information will be bound by confidentiality obligations.

CALIFORNIA SHINE THE LIGHT NOTICE

This Shine the Light Notice provides information on our online practices and the rights of California residents specific to our online services. Without limitation, Californians that visit our online Services and seek to acquire goods, services, money or credit for personal, family or household purposes are entitled to the following notices of their rights:

California's “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Websites who are California residents to request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. In your request, please attest to the fact that you are a California resident and provide a current California address for your response. We will not accept Shine the Light requests by telephone or by fax, and are not responsible for requests not labeled or sent properly, or that are incomplete.

YOUR STATE DATA PRIVACY RIGHTS

Residents of certain jurisdictions, such as Virginia, Nevada, Tennessee, Indiana, and Kentucky, may have additional rights with respect to their Personal Information under applicable state consumer data privacy laws. These rights are described below:

Right to Confirm

You have the right to confirm whether or not we are processing your personal information. 

Your request to confirm may be denied for any reason allowable under applicable state privacy law. For example, we may deny your request to delete if the personal information is necessary for us or a service provider to complete the transaction for which we collected the personal information, comply with a legal obligation, or make other internal or lawful uses of that information that are compatible with the context in which you provided.

Right to Access

You have the right to access your personal information, subject to exceptions set out in applicable privacy legislation. Examples of such exceptions include:

  • Information that is aggregated or de-identified.
  • Information that is part of a formal dispute resolution process.
  • Information that is about another individual that would reveal their personal information or confidential commercial information.
  • Information that is prohibitively expensive to provide.

Right to Delete

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

  • Delete your personal information from our records;
  • Direct any service providers or contractors to delete your personal information from their records; and
  • Direct third parties to whom the business has sold or shared your personal information to delete your personal information unless this proves impossible or involves disproportionate effort.

Your request to delete may be denied for any reason allowable under applicable state privacy law. For example, we may deny your request to delete if the personal information is necessary for us or a service provider to:

  • Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;
  • Help to ensure security and integrity to the extent the use of the consumer's personal information is reasonably necessary and proportionate for those purposes;
  • Debug to identify and repair errors that impair existing intended functionality;
  • Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;
  • Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us
  • Comply with an existing legal obligation; or
  • Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.

Right of Correction

If we maintain inaccurate personal information about you, you have the right to request us to correct that inaccurate personal information. Upon receipt of a verifiable request from you, we will use commercially reasonable efforts to correct the inaccurate personal information.

Right to Obtain a Copy

You also have the right to obtain a copy of the personal information you have provided to us in a portable, readily usable format that can be easily transferred to a third party.

Right to Opt-Out

You have the right to opt out of the following uses of your personal information:

  • Sharing or your personal information for targeted behavioral advertising; and
  • Profiling.

We will act upon your request to opt-out no later than 15 days from the date we received the request. Note that we may deny a request to opt-out if we have a good-faith, reasonable, and documented belief that the request is fraudulent or for any other reason allowable under applicable state privacy law. Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sharing.

Right to Limit Use of Sensitive Personal Information

We may collect sensitive data about you, including your account login information or other credentials, social security number, government identification numbers, financial information, and precise geolocation. We take specific business practices to limit the use and disclosure of sensitive personal information, such as requiring your express consent for the collection of sensitive information.

You may direct us to limit the use of this sensitive information only for purposes necessary to:

  • Perform the services or provide the goods requested by you
  • Help ensure the security and integrity of the use of your information
  • Perform services on behalf of our business, such as maintaining or servicing accounts, providing customer service, processing or fulfilling orders, payments, ore rturns, or verifying customer information
  • Undertaking activities to verify the quality of, maintain, or improve our services or systems

You have a right to know if your sensitive personal information is used or disclosed to a service provider or contractor, for additional, specified purposes.

We will not use your sensitive information for any purpose other than those allowed under applicable law. You may limit the use of sensitive information for purposes other than necessary to perform the service that you request from us containting us.

Right to Non-Discrimination

You have the right to not be retaliated or discriminated against by us because you exercised any of your rights. This means we cannot, among other things:

  • Deny goods or services to you;
  • Charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;
  • Provide a different level or quality of goods or services to you; or
  • Suggest that you will receive a different price or rate for goods or services or a different level or quality of goods or services.

Please note that we may charge a different price or rate or provide a different level or quality of goods and/or services to you, if that difference is reasonably related to the value provided to our business by your personal information. We may also offer loyalty, rewards, premium features, discounts, or other programs consistent with these rights or payments as compensation, for the collection of personal information, the sale of personal information, or the retention of personal information.
